Mediation

 

Mediation is an informal, semi-structured process in which an impartial third party (a mediator) assists disputing parties to work through and resolve problems or conflicts together. It is a non-judgmental process that focuses on helping parties find mutually satisfying resolutions to their problems, consistent with each of their interests and without formal grievance proceedings. 

What topics are appropriate for mediation?

Mediation is an appropriate tool for dealing with most interpersonal and work related conflicts, including personal disputes, office behaviors, issues of respect and cooperation. It also is an effective tool for addressing many content or process conflicts related to work assignments and duties, such as resource allocation, operational authority and ownership issues. 

Some issues may not be appropriate for mediation.  For example, mediation of current or pending legal actions, some organizational decisions, conflicts surrounding violations or applications of company policies, or concerns relating to serious violations of rights or regulations may not be appropriate for mediation through the program. 

Why consider mediation?

The mediation program is intended to assist employees in resolving conflicts amicably, without the need for formal grievances or other adversarial forms of formal dispute. While most companies have well-established procedures for the resolution of formal grievances, the workplace community benefits from alternative dispute resolution mechanisms that provide more collegial, less adversarial means to resolve disputes.  As our focus is career development and workplace culture enhancement, we will assist you with addressing developmental and skill issues that may be underlying causes of the initial need for mediation. 

Does mediation work? 
 

Mediation has a high success rate. Even in cases in which a complete resolution is not reached, it often paves the way to an eventual solution by increasing understanding and facilitating communication.  Those who have participated in mediation routinely rate it as an “extremely positive and worthwhile experience.”

 

What does the mediation process involve? 
 

An employee with a work-related conflict contacts or is referred to the service. We provide a basic overview of the service and contact the second party to provide that person with an overview of the process and to offer the service. If both parties agree to participate in mediation, the process begins. A speedy, but fair and mutually satisfactory agreement is always the objective and usually the outcome.  Human Resources is involved in the process to the extent that they wish with all parties informed of this involvement. We have been most successful when Human Resources acts as a referring agent and receives basic reports about the outcomes of the situation. The average consultant time for the process is usually under 4 hours.
 

As our mediation process involves both resolution of the current situation as well as professional and personal career development planning related to the core issues of the situation, we further ensure success by following up with those involved. This usually takes place at a two week and ten week interval and is usually accomplished by phone.  The goals of the follow up are to confirm that the agreement is a long term solutions, to assist participants with lessons learned, and to provide further opportunity for development.
